Kakamega

By Hon. David Ndakwa

After the passage of 2010 Constitution, laws were put in place as to the Establishment of a Government, which carries the majority of votes and seats in County Assemblies, National Assembly and the Senate with the formation of the Opposition, which has the Minority.

While the Majority forms a Government, the Minority becomes a watchdog playing an oversight role to the same Government at each term.

Kenyan Political Parties came up with Pre Election Coalitions, which by law, will survive until the end of tenure of ruling government until 2022.

NASA, which comprises of ANC, Wiper, ODM and Ford Kenya, formed the Opposition in Kenya after the 2017 General Elections. This, as a result, created offices for Senator James Orengo as The Minority Leader in the Senate while John Mbadi assumed the office of The Minority Leader in the National Assembly on NASA coalition parties strengths. Jubilee Party formed another coalition after other parties like URP and TNA among others folded.

The NASA coalition partners currently head Key Parliamentary Committees in both houses; the Public Accounts Committee and the Public Investment Committee.

It will therefore be deceitful, for any Political Party to purport to be forming a Post-Election Agreement with Jubilee, when NASA Coalition is still alive.

In any case, any Party from the Opposition, desirous to joining government MUST first write to the Office of the Registrar of Political Parties, with a threshold majority of three,(3) parties, declaring withdrawal from NASA Coalition.

Thus, it is until then therefore, when the ORPP would give a notification in writing allowing individual Parties to fold from NASA and allow them to deposit fresh coalition agreements.

Unless this is done, it amounts to political conmanship, greed, dishonesty and disrespect to both Kenyans and to the rule of law by purporting to have made or intended to make a Post 2017 poll agreement with Jubilee, when the latter coalitions are still in place.

As things stands, ANC, Wiper, Ford Kenya and ODM forms the Official Opposition in Kenya!

Kenyan scenarios makes me think that government of National Unity do not promote democracy but defeats it, because our political parties have no ideologies, but mere vehicles for securing power.

“Good politics improves systems and institutions, Bad politics always try to concentrate power in individuals and criticize other individuals for problems.”
